Terms of Service

The following Terms of Service (herein named TOS) applies to all websites/domains hosted by HostRefugee. The term "applies" is defined as total content of each website/domain, as well as "links" from any website/domain, or to any website/domain.

1. Pornography and sex-related merchandising are prohibited. This includes sites that may infur sexual content, or links to pornography elsewhere. Nude "art" is permitted.

2. You may not upload any material that violates or infringes on the copyright, intellectual property rights or trademark rights of any individual or organization.

3. Piracy, hacking, cracking, phreaking, warez, pyrotechnics, exploitive software or text that educates or encourages this activity and/or use are not allowed. This includes linking to such material from your web site. You may not upload ROMs and Emulators. This is non-negotiable.

4. Proxy Sites are not allowed on our service.

5. You may not publish any material that is grossly offensive, including , exploitation of children, blatant expressions of bigotry, hatred, harassment, defamation, or invasion of privacy. This includes material that defames, abuses, harasses or threatens any person or group.

6. Mass Mailings. HostRefugee has a zero stance policy on SPAM, Junk E-mail or UCE. Spam, Junk-mail and UCE are defined as: the sending of the same, or substantially similar, unsolicited electronic mail messages, whether commercial or not, to more than one recipient. A message is considered unsolicited if it is posted in violation of a newsgroup charter or if it is sent to a recipient who has not requested or invited the message. UCE also includes e-mail with forged headers, compromised mail server relays, and false contact information. This prohibition extends to the sending of unsolicited mass mailings from another service, which in any way implicates the use of HostRefugee whether or not the message actually originated from our network.

Mailing Lists:HostRefugee's mass mailing rules also apply to mailing lists, list servs, or mailing services you may contract with. The policy is stated as follows: An acceptable mailing list will be focused at a targeted audience that has voluntarily signed up for your e-mail information or that has made their e-mail address available for distribution of information from you. The list must also allow for automatic removal by all end Customers with non-distribution in the future.

Accounts found to be participating in any of the activities listed above will be terminated immediately with no refund.

7. If you received a free domain name as part of a special or custom sales arrangement, you agree to stay with us for a minimum of 6 months. If you wish to claim ownership, transfer the domain, or move the domain to another hosting service before the 6 months is up, you agree to pay the original registration fee of $10.00. After this 6 month period, you are free to do whatever you wish with the domain without paying any additional fee.

8. You may not use your service in the commission of any crime that violates the laws of local, state, and federal government of the United States of America.

9. You are solely and fully responsible for the contents of your account. Any and all repercussions will be born solely by you as the account holder.

10. In no event will HostRefugee be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use HostRefugee's services or any content thereon. This disclaimer applies, without limitation, to any damages or injury, whether for breach of contract, tort, or otherwise, caused by any failure of performance; error; omission; interruption; deletion; defect; delay in operation or transmission; computer virus; file corruption; communication line failure; network or system outage; or theft, destruction, unauthorized access to, alteration of, or use of any record. In the event of company downtime, you may be entitled to a credit as outlined in our Service Level Agreement.

11. We reserve the right to terminate any account without warning or notice if any of the above restrictions are violated and to examine the contents of any account at any time.

12. Our 30 Day money back guarantee applies only towards shared and reseller hosting plans. Services such as Domain Registraion, SSL Certificates, and Dedicated IP's are non-refundable. Other services HostRefugee offers or may offer in the future are non-refundable unless stated otherwise.

13. HostRefugee reserves the right to update our terms of service at any time.
